Terms and conditions

Only the German version is legally binding.

§ 1 Scope and provider

These terms apply to all contracts for domains between [please add], [please add], [please add], Germany ("we") and customers of the domainshop by Wieser-HV.

§ 2 Services

(1) We register, renew and manage domains on behalf of the customer with the relevant registry, using a technical provider.
(2) Until registration we cannot guarantee that a domain is available. If registration is not possible, nothing is charged for that domain.
(3) Services include nameserver and DNS management, owner changes, the auth code and cancellation in the customer account.
(4) Private individuals may use free WHOIS protection. Whether and how the registry hides the data depends on the extension; we forward requests to the owner as far as they reach us.

§ 3 Conclusion of contract

(1) Clicking "Place order with obligation to pay" is a binding offer by the customer.
(2) The contract for a domain is concluded upon its registration, which we confirm by email.

§ 4 Prices and payment

(1) The prices shown at the time of order apply. All prices are final; no VAT is charged (small business, § 19 UStG).
(2) For new orders the amount is only authorised and charged after registration – only for domains actually registered.
(3) Renewals and transfers are charged when ordered; if the service fails, we refund the amount.

§ 5 Term, renewal and cancellation

(1) The term corresponds to the ordered period (usually one year).
(2) A domain is renewed only if the next term is paid. With automatic renewal and a saved payment method we announce the charge in advance; otherwise the customer receives an invoice with a payment link before expiry.
(3) The customer may cancel at any time with effect from the end of the term – in the account or without signing in via "Cancel contracts here".
(4) If the next term is not paid [7] days before expiry, we cancel the domain at the end of the term.

§ 6 Customer obligations

(1) The customer provides correct and complete owner data, keeps it up to date and proves it within 24 hours if the registry requests.
(2) The terms of the relevant registry also apply (e.g. DENIC for .de, ICANN rules for generic extensions).
(3) The customer ensures that the domain and its use do not infringe third-party rights.

§ 7 Owner change and transfer

(1) An owner change may incur costs depending on the extension; they are shown before execution. For generic extensions a transfer may be locked for 60 days afterwards.
(2) The auth code for a transfer is available in the customer account. A transfer ends our contract for the domain without refund of the current term.

§ 8 Suspension and termination for cause

We may suspend or cancel a domain if the registry requires it or there is good cause (e.g. obviously unlawful use, incorrect owner data despite request).

§ 9 Liability

(1) We are liable without limitation for intent, gross negligence and injury to life, body or health.
(2) For slightly negligent breach of essential obligations, liability is limited to foreseeable, typical damage; otherwise excluded.
(3) We are not liable for failures of registries or third parties beyond our control.

§ 10 Right of withdrawal

Consumers have a right of withdrawal as set out in the withdrawal information. It expires once the domain has been registered at the consumer's express request before the end of the withdrawal period.

§ 11 Final provisions

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods; for consumers only insofar as mandatory consumer protection law of their country of residence does not prevail.
